Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couples.

A profession that we are a nation "under God" is identical, for establishment clause purposes, to a profession that we are a nation "under Jesus," a nation "under Vishnu," a nation "under Zeus," or a nation "under no god," because none of these professions can be neutral with respect to religion.

The truth is that trout fishermen scheme and lie and toss in their sleep. They dream of great dripping trout, shapely and elusive as mermaids, and arise cranky and haggard from their fantasies. They are moody and neglectful and all of them a little daft. Moreover they are inclined to drink too much.

When I say that a thing is true, I mean that I cannot help believing it... But...I do not venture to assume that my inabilities in the way of thought are inabilities of the universe. I therefore define truth as the system of my limitations, and leave absolute truth for those who are better equipped.

While I sat in family court, I probably heard 20 or 25,000 cases. And I am sure, during the course of those cases, there were cases that I probably would've decided differently had I had either more time or been able to explore more. If the church could catch a vision for using video technology to present an authentic presentation of the life of the church - not rehearsed videos, but spontaneous records of conversations, laughing with one another, weeping with one another, people sharing their lives, etc. - the average person might take notice.

If the Government is going to intrude upon the sacred ground of the First Amendment and tell its citizens that their exercise of protected speech could land them in jail, the law imposing such a penalty must clearly define the prohibited speech not only for the potential offender but also for the potential enforcer.

To try to regulate the internal affairs of a family, the relations of love or friendship, or many other things of the same sort, by law or by the coercion of public opinion, is like trying to pull an eyelash out of a man's eye with a pair of tongs. Sympathy is the first great lesson which man should learn. It will be ill for him if he proceeds no farther; if his emotions are but excited to roll back on his heart, and to be fostered in luxurious quiet. It is time... to end the long-standing and unproductive methodological debate over 'originalism' versus 'dynamism' or 'evolution' and focus instead on how, as a substantive matter, we should interpret the Constitution in the twenty-first century, and what it has to say on questions unimaginable to our eighteenth-century Framers.

There is no more reason to think that they expected the world to remain static than there is to think that any of us holds a crystal ball. The only way to create a foundational document that could stand the test of time was to build in enough flexibility that later generations would be able to adapt it to their own needs and uses.

There is no surer way to misread any document than to read it literally. As nearly as we can, we must put ourselves in the place of those who uttered the words, and try to divine how they would have dealt with the unforeseen situation; and, although their words are by far the most decisive evidence of what they would have done, they are by no means final.

The majority falls prey to the delusion–popular in some circles–that ordinary people are too careless and stupid to own guns, and we would be far better off leaving all weapons in the hands of professionals on the government payroll. The First Amendment is really at the very core of political speech, and political speech is at the core of the First Amendment. So, we want to be very careful to make sure that candidates for office are free to express their views so that people will make an informed choice. We don't want them holding back, and sort of concealing their views and then disclosing them afterwards.

Liberty lies in the hearts of men and women; when it dies there, no constitution, no law, no court can save it ... Although cohabitating same-sex couples are prohibited from jointly adopting children under Utah law as a result of the same-sex marriage ban, the record shows that nearly 3,000 Utah children are being raised by same-sex couples. Thus childrearing, a liberty closely related to the right to marry, is one exercised by same-sex and opposite-sex couples alike, as well as by single individuals.

Our legal system, including the police, is anti-Dalit and anti-poor. The death penalty laws' wrathful majesty, in blood-shot equality, deals the fatal blow on the poor not the rich, the pariah not the brahmin, the black not the white, the underdog not the top dog, the dissenter not the conformist. . . The law barks at all but bites only the poor, the powerless, the illiterate, the ignorant.

Overprotecting intellectual property is as harmful as underprotecting it. Creativity is impossible without a rich public domain. Nothing today, likely nothing since we tamed fire, is genuinely new: Culture, like science and technology, grows by accretion, each new creator building on the works of those who came before. Overprotection stifles the very creative forces it's supposed to nurture.

Defendants' essential contention is that bans on same-sex marriage promote the welfare of children, by encouraging good parenting in stable opposite-sex families.... Defendants have presented no evidence of any such effect. Indeed, they cannot even explain the manner in which, as they predict, children of opposite-sex couples will be harmed. Their other contentions are equally without merit.

I fish because I love to . . . because I love the environs where trout are found . . . because I suspect that men are going along this way for the last time, and I for one don’t want to waste the trip . . . and, finally, not because I regard fishing as being so terribly important but because I suspect that so many of the other concerns of men are equally unimportant––and not nearly so much fun.

The other General Welfare Clause is in the first of the authorities given to the Congress and it's not a grant, it's a restriction. By which I mean it doesn't say Congress can legislate for the general welfare, it means that everything Congress must do has to enhance the general welfare of the United States of America. It can't grant things to individuals, it can only legislate for the government.

Cannabis never killed anybody and it's use is widespread. You can"t stop it. The law defeats itself because all the efforts to stop drugs coming in only drives up the prices and then gangsters move in to push the drugs. If they legalised there wouldn't be gangsters and huge profits...The police are gradually decriminalising the possession of cannabis because they realise there's not much point prosecuting

I often wonder whether we do not rest our hopes too much upon constitutions, upon law and upon courts. These are false hopes, believe me, these are false hopes. Liberty lies in the hearts of men and women; when it dies there, no constitution, no law, no court can save it; no constitution, no law, no court can even do much to help it. While it lies there it needs no constitution, no law, no courts to save it.

Each one of us must in the end choose for himself how far he would like to leave our collective fate to the wayward vagaries of popular assemblies For myself it would be most irksome to be ruled by a bevy of Platonic Guardians, even if I knew how to choose them, which I assuredly do not I should miss the stimulus of living in a society where I have, at least theoretically, some part in the direction of public affairs.

My excellent colleagues have forgotten these bitter lessons of history. The prospect of tyranny may not grab the headlines the way vivid stories of gun crime usually do. But few saw the Third Reich coming until it was too late. The Second Amendment is a doomsday provision, one designed only for those exceptionally rare circumstances when all other rights have failed. A free people can only afford to make this mistake once.

But elimination will only happen if all countries - nuclear and non-nuclear states - genuinely work towards this result. Nuclear states must abolish their arsenals, as was indicated by the unanimous opinion of the international Court of Justice, the highest international tribunal. The five nuclear states seem to expect others to refrain from obtaining bombs while at the same time maintaining their own caches of deadly weapons.

It is often hard to secure unanimity about the borders of legislative power, but that is much easier than to decide how far a particular adjustment diverges from what the judges deem tolerable. On such issues experience has over and over again shown the difficulty of securing unanimity. This is disastrous because disunity cancels the impact of monolithic solidarity on which the authority of a bench of judges so largely depends.

Simply according artistic works the same protection as nonartistic works may not be sufficient to protect creativity. After all, the very essence of artistic expression is invention and artists necessarily draw on their own experience. But if the rules of liability are unclear, artists will not be able to know how much disguise is sufficient to protect their claims from the claims of those who may see themselves in the portrayals.

To me this question whether liberty is a good or a bad thing appears as irrational as the question whether fire is a good or a bad thing. It is both good and bad according to time, place, and circumstance, and a complete answer to the question, In what cases is liberty good and in what cases is it bad? would involve not merely a universal history of mankind, but a complete solution of the problems which such a history would offer.

The advertising industry is one of our most basic forms of communication and, allegedly, of information. Yet, obviously, much of this ostensible information is not purveyed to inform but to manipulate and to achieve a result - to make somebody think he needs something that very possibly he doesn't need, or to make him think one version of something is better than another version when the ground for such a belief really doesn't exist.

In a very real sense, the Constitution is our compact with history . . . [but] the Constitution can maintain that compact and serve as the lodestar of our political system only if its terms are binding on us. To the extent we depart from the document's language and rely instead on generalities that we see written between the lines, we rob the Constitution of its binding force and give free reign to the fashions and passions of the day.

The Second Amendment is a doomsday provision, one designed for those exceptionally rare circumstances where all other rights have failed - where the government refuses to stand for reelection and silences those who protest; where courts have lost the courage to oppose, or can find no one to enforce their decrees. However improbable these contingencies may seem today, facing them unprepared is a mistake a free people get to make only once.

We recognize that same-sex marriage makes some people deeply uncomfortable. However, inertia and apprehension are not legitimate bases for denying same-sex couples due process and equal protection of the laws. Civil marriage is one of the cornerstones of our way of life. It allows individuals to celebrate and publicly declare their intentions to form lifelong partnerships, which provide unparalleled intimacy, companionship, emotional support and security.

You cannot raise the standard against oppression, or leap into the breach to relieve injustice, and still keep an open mind to every disconcerting fact, or an open ear to the cold voice of doubt. I am satisfied that a scholar who tries to combine these parts sells his birthright for a mess of pottage; that, when the final count is made, it will be found that the impairment of his powers far outweighs any possible contribution to the causes he has espoused.

Anyone may arrange his affairs so that his taxes shall be as low as possible; he is not bound to choose that pattern which best pays the treasury. There is not even a patriotic duty to increase one's taxes. Over and over again the Courts have said that there is nothing sinister in so arranging affairs as to keep taxes as low as possible. Everyone does it, rich and poor alike and all do right, for nobody owes any public duty to pay more than the law demands.

There is absolutely no reason to suspect that prohibiting same-sex couples from marrying and refusing to recognize their out-of-state marriages will cause same-sex couples to raise fewer children or impel married opposite-sex couples to raise more children. The Virginia Marriage Laws therefore do not further Virginia's interest in channeling children into optimal families, even if we were to accept the dubious proposition that same-sex couples are less capable parents.

I have heard Shree Rajneesh and have been inspired by his talks. His works are sublimne and seek to liberate the soul of humans. Indeed his presentation is unique, his goal is great and his success in liberating each person from the mafia surrounding the soul is rewarding reading. The message that he had to deliver must reach everywhere. Ultimately salvation comes when one attains freedom from oneself. That, I believe, is the consummation which exposure to Osho may help.
